(Fulton County Georgia State Court) Robert J. Fleming successfully tried to verdict this medical malpractice case against a number of defendant doctors.The client suffered loss of vision in her right eye after her blood levels were not properly monitored following surgery in the hospital and after she was release to home health care despite being prescribed and administrated Coumadin, a well known blood-thinning medication that must be monitored closely to avoid complications. After a two week trial, the jury awarded damages to the clients in the amount of $5,500,000. This was Mr. Fleming's first trial as lead counsel in a medical malpractice case. $3.25 Million for Alleged Fraud in Sale of Business
(U.S. District Court--Northern District of Georgia) Mr. Fleming successfully represented the founders of a medical office practice management company who sold their business to the defendant Atlanta company in exchange for stock in the defendant company. Shortly after the sale, and before Plaintiffs could sell their newly acquired shares, the defendant's stock price plummeted. Suit was filed in the Northern District of Georgia Federal Court alleging, among other things, breach of contract, and fraud and misleading statements by defendants during the sale negotiations. The case settled on the eve of trial for $3,250,000.
$1.9 Million Recovered in Pay Dispute
Mr. Fleming successfully represented a business consultant to a clothes manufacturer. The manufacturer hired the consultant and promised to pay him in corporate shares at a time when its shares were selling for about $1/share. The value of the promised shares at the time the parties entered into the consulting agreement was approximately $100,000. Shortly thereafter, the shares rose to over $23/share and the manufacturer refused to pay the consultant in shares, alleging that it was only bound to pay the consultant $100,000 (the value of the shares at the time of the contract). Suit was filed in federal court and the case settled days before trial for over $1,900,000.

Robert J. Fleming represented a 50 year-old woman who had taken blood pressure medication for approximately 30 years. For the past 7 years, a major pharmacy chain had filled her prescribed blood pressure medication. The pharmacy negligently gave the client the wrong blood pressure medication, which was twice her required dosage. Soon thereafter, she experienced a life threatening reaction and had to be rushed to the emergency room. Upon receiving the wrong medication, the client noticed that the medication given to her was a different color than her usual medication. Concerned, she spoke with the pharmacy technician about whether she had been given the wrong medication. Having been put on notice of the pharmacy’s serious mistake, the technician assured the client that the medication was indeed her correct dose. The technician stated that the color difference was due to a change in the manufacture (supplier) of the medication. Relying on the technician’s assurances, the client returned home and began taking --what in fact--was a double dose of her required medication. Within days, she was rushed to the hospital: her blood pressure had begun fluctuating, taking sharp declines; her throat had begun to tighten; and she had begun experiencing severe pain in her chest, as well as radiating pain throughout her left arm.
